Possible Scope of Presidential Proclamation Suspending Entry of Certain NIVs

Possible Scope of Executive Order suspending entry of certain Non Immigrant Visas (NIV's) holders to the US.

We are advised that President Trump will be issuing an Executive Order in the next two weeks that would bar the entry of L-1, H-1B, H-2B and J-1 non-immigrants to the U.S. 

Specific details have not been released, however the ban may last for 90 or 180 days. Reference is made to “exemptions” for L-1A managers/executives, health care workers, workers in food-related industries and where an employer has gone through a competitive recruiting process. 

It is believed that J-1 provisions will only affect summer workers, camp counselors, trainees and interns and not physicians.  Please note that until the Proclamation is issued, we will not know the complete scope of these limitations 

How this may impact KTA Clients

1. Any employees holding L-1, H-1B, H-2B and J-1 visas who are currently outside the U.S. should consider returning to the U.S. as soon as possible.  While we do not know when the Executive Order will take effect, it may be assumed it will be shortly after President Trump makes the announcement.  

2. It is recommended that employees currently in the U.S. in L-1, H-1B, H-2B and J-1 status - remain, until it is known whether you will be allowed to return to the U.S. once they leave.  

3. It is unclear as to the impact on pending or approved visa applications. We therefore recommend that you continue to file extension of status applications in a timely manner.
